An expert in the commercial trucking industry was requested as a consultant on a breach of contract action between a chain of retail stores and the distribution company that supplied them. The plaintiff picked up goods from the defendant’s warehouse and transported them to its own warehouse where the goods were sorted, repacked, and shipped to the customer’s retail stores. The main issue revolved around the “density of packing” of the goods as they were loaded from defendant’s warehouse onto the plaintiff’s trucks. Specifically, the issue was the density in shipping versus the weight in shipping. There was a “deficit weight charge” determined by the density of the goods as they were loaded. The trucking company was paid by the hundredweight for shipping and, apparently, if the goods were more densely packed the number of hundredweight increased.
