An expert in mold remediation was requested to review more than $10 million dollars in remediation costs systems for a breach of contract case to determine if those costs directly related to the buildings’ HVAC system. Two newly constructed buildings closed due to the alleged growth of mold within them. The plaintiff then spent $10 million redesigning, remodeling, and rebuilding, and sought to recover that amount from the original contractors and subcontractors. Plaintiff alleged the mold problem was a result of the negligent construction, supervision, inspection, design, and installation of the building’s condensate drain systems, equipment, HVAC systems, roof systems,
building envelope systems, drain site systems, plumbing systems, equipment, and the use of improper materials in the construction of the buildings.
