NLJ Award - IMS ExpertServices Voted Best Expert Witness Provider by the National Law Journal

Legal Ethics Expert for Securities Litigation

Case Description:

An expert in legal ethics was needed for securities litigation where the plaintiffs were suing their legal counsel over monies lost to a Ponzi scheme. The plaintiffs were assured by their attorney that proposed loans were a good and safe investment, that the operation was completely legal, and represented that it was not a security. The company to which the money was lent was shut down by the Securities and Exchange Commission, SEC, as part of a Ponzi scheme. The plaintiffs hoped to recover some of their loss from the firm's Professional Errors and Omissions (E&O) Liability Coverage.

IMS ExpertServices was asked to locate a legal ethics expert familiar with the securities industry who could opine on professional ethics and fiduciary duty.
