NLJ Award - IMS ExpertServices Voted Best Expert Witness Provider by the National Law Journal

Energy Trading Expert in Securities Fraud

Case Description:

An energy trading expert was needed for a securities fraud case involving pre-paid commodities trades. The defendant, a large banking corporation, made energy trades with a corporation that subsequently went bankrupt without delivering the physical assets. The plaintiffs alleged that pre-paid commodities trades (using funds raised from the plaintiff's securities trusts) in which physical assets were never delivered were therefore disguised loans. The plaintiffs further alleged that the defendant executed the trades as a form of risk mitigation, knowing the corporation was filing bankruptcy.

IMS ExpertServices was asked to locate an energy trading expert with extensive, practical experience in the commodities trading industry who was also knowledge of financial risk management strategies. The expert was requested to consult as to whether it was customary in the industry to enter pre-paid commodities transactions without actual delivery of the physical assets.
