Asbestos Removal Expert in Construction Safety Standards

Case Description:

An asbestos removal expert was sought for a case involving federal regulatory compliance in construction safety and hazardous materials handling. An apartment building renovation project resulted in an indictment by the federal government for: 1) Failure to File Demolition/Renovation Notice and; 2) Failure to Comply With NESHAP (National Emissions Standards for Hazardous Air Pollutants) Work Practice Standards. At issue in this case was whether or not the developer’s actions were consistent with accepted industry standards of care with regard to the arrangements and precautions that were taken in preparation for the removal of asbestos.

IMS ExpertServices was asked to find an asbestos removal expert, specifically a construction safety specialist who was familiar with the necessary, reasonable, and commercially acceptable business arrangements developers must take when planning to remove asbestos from small apartment buildings. The expert also needed to be familiar with the Asbestos Hazard Emergency Response Act (AHERA) and the National Emissions Standards for Hazardous Air Pollutants (NESHAP).
