Case Description:

A commercial property expert and real estate broker was needed for a professional malpractice case. The plaintiff was a financial institution that owned a commercial property and sought to determine whether it would be better to continue to own the building or to sell the building then lease back the space it used. Plaintiff sold when the financial analysis and assessment it commissioned from the defendant concluded there would be greater benefit to the sale/leaseback transaction. Plaintiff later sued the defendant for negligence and breach of fiduciary duty, claiming a properly conducted financial analysis would have shown that continued ownership of the commercial property was preferable.
