Insurance Regulations Expert in Exclusion Clauses

Case Description:

An insurance regulations expert in exclusion clauses was needed to opine on pre-existing conditions for a class action suit alleging bad faith. The plaintiffs held health insurance policies provided by the defendant which included pre-existing condition exclusion clauses. Certain insurance claims were denied based on the exclusion clause. The plaintiffs alleged the pre-existing condition language violated state law and therefore was void.

IMS ExpertServices was asked to locate experts in insurance regulations who had experience with pre-existing condition riders and exclusion clauses. Our client wanted an expert who had specialized in state insurance regulation in one of the plaintiff states and who was familiar with standards of the National Association of Insurance Commissioners.
