Case Description:

A land surveying expert in boundary disputes was needed for a subrogation action. Plaintiff wrote a commercial title insurance policy based on a land survey conducted by the defendant. After construction was underway it was discovered that the land survey was incorrect. As a result buildings constructed on the property were out of compliance with zoning regulations and a ground water treatment system had been mislocated on someone else’s property. Plaintiff sought damages and charged the defendant with negligent misrepresentation, professional malpractice, and violation of state laws prohibiting unfair and deceptive business practices.
